he/she doesn’t have a driving license it was because he/she doesn’t need one to take up his right of travelling freely & unhindered, & because the license is the contract to drive, he wasn’t driving so didn’t need a license

Just to add a technicality. He/she is not a paid "Driver" therefore does not need a "Driver's" licence. He drives from A to B on a social and domestic insurance policy but as a traveller in the private not a "Driver in commerce"
